1. Introduction

This Privacy Policy explains how NOVARIX FASHION LLC ("NOVARIX," "we," "us," or "our") collects, uses, stores, and shares personal information when you visit novarixstore.com (the "Site"), place an order, or otherwise interact with us. NOVARIX is an online apparel store offering men's and women's clothing, including T-shirts, hoodies, sweatshirts, tank tops, and related fashion items, to customers in the United States and Europe.

Our store is hosted on Shopify, an e-commerce platform that provides the technology we use to run the Site and process orders. Please read this Privacy Policy carefully. If you do not agree with it, please do not use the Site.

2. Information We Collect

The information we collect depends on how you interact with the Site.

Information you provide to us

  • Contact and account details: your name, email address, phone number, and, if you create an account, your login details.
  • Order and shipping information: billing address, shipping address, the items you purchase, sizes and variants selected, order value, discount codes used, and your order, return, and exchange history.
  • Payment information: payment method and transaction details. Payment card details are collected and processed by our payment processors, as described in Section 6.
  • Communications: the content of messages you send us, such as customer support inquiries or responses to our emails.
  • Marketing preferences: whether you have subscribed to or unsubscribed from our marketing emails.

Information collected automatically

  • Device and connection information: IP address, browser type, operating system, device identifiers, language, and approximate location derived from your IP address.
  • Usage information: pages and products you view, items added to your cart, links you click, the page that referred you to the Site, and the dates and times of your visits.

This information is collected through cookies and similar technologies, as described in Section 4.

Information from third parties

We may receive information from Shopify, payment processors, shipping carriers, and other service providers that support our store, such as payment confirmation, fraud-screening results, and delivery status.

3. How We Use Your Information

We use personal information to:

  • process and fulfill orders, including taking payment, arranging shipping, and handling returns and exchanges;
  • send order confirmations, shipping updates, and other messages related to your purchase;
  • create and manage your customer account, if you choose to open one;
  • respond to your questions and provide customer support;
  • send marketing emails about products and offers, where you have signed up to receive them or where otherwise permitted by law. You can unsubscribe at any time using the link in any marketing email;
  • operate, maintain, analyze, and improve the Site and our product range;
  • screen orders for potential fraud and protect the security of the Site, our customers, and our business; and
  • comply with legal obligations, such as tax and accounting requirements, and establish or defend legal claims.

4. Cookies and Tracking Technologies

The Site uses cookies and similar technologies, such as pixels and local storage. Cookies are small files placed on your device that allow a website to recognize your browser.

We use these technologies to:

  • run the store: keep items in your cart, enable checkout, keep you signed in, and remember your preferences;
  • understand performance: measure visits, see which pages and products are popular, and identify technical problems; and
  • support marketing: where such tools are in use, measure the effectiveness of our marketing (see Section 8).

Many of the cookies on the Site are set by Shopify as part of the platform. Shopify publishes information about the cookies it uses at shopify.com/legal/cookies.

Most browsers let you block or delete cookies through their settings. If you block cookies that are necessary for the store to function, some features, including the cart and checkout, may not work properly.

5. Shopify and Third-Party Services

Our store is powered by Shopify. Shopify hosts the Site, stores order and customer data on our behalf, and provides checkout, analytics, and other store functionality. Information you submit through the Site is therefore processed by Shopify. To learn more about how Shopify handles personal information, see the Shopify Privacy Policy at shopify.com/legal/privacy.

We also work with other third-party service providers that help us operate our business, such as payment processors, order fulfillment and production partners, shipping carriers, and email service providers. These providers receive only the information they need to perform their services for us.

The Site may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.

6. Payment Processing and Security

Payments on the Site are handled by third-party payment processors made available through our Shopify checkout. The payment methods available to you are shown at checkout. When you pay for an order, your payment card or account details are transmitted directly to the payment processor. NOVARIX does not store your full payment card number or card security code.

We receive limited information about your payment, such as the payment method used, the card type and last four digits, the billing address, and whether the payment was approved, so that we can process and manage your order. Your use of a payment processor's service is also subject to that processor's own terms and privacy policy.

7. Sharing of Personal Information

We share personal information only in the circumstances described below:

  • Service providers: with Shopify and other vendors that perform services for us, including payment processing, order fulfillment and production, shipping and delivery, email delivery, analytics, and customer support.
  • Shipping carriers: your name, shipping address, and contact details are shared with carriers so that your order can be delivered and you can receive delivery updates.
  • Legal and safety reasons: where we believe disclosure is necessary to comply with applicable law or a valid legal request, to enforce our terms, to investigate fraud, or to protect the rights, property, or safety of NOVARIX, our customers, or others.
  • Business transfers: in connection with a merger, sale of assets, financing, or acquisition of all or part of our business, in which case personal information may be transferred to the successor entity.
  • With your consent: in any other case where you ask us or agree for us to share your information.

We do not sell your personal information in exchange for money.

8. Advertising and Analytics

We use the analytics tools built into Shopify to understand how visitors use the Site, such as how many people visit, which products are viewed, and how orders are placed. This helps us improve the store and our product offering.

As of the "Last updated" date above, we do not use third-party advertising pixels on the Site. If we begin using advertising or analytics services provided by third parties, such as social media or search advertising platforms, those services may collect information about your activity on the Site through cookies or similar technologies in order to measure and deliver advertising. We will update this Privacy Policy to describe those services before or when we start using them.

9. International Data Transfers

NOVARIX FASHION LLC is based in the United States. If you are located outside the United States, including in the European Economic Area, the United Kingdom, or Switzerland, your personal information will be transferred to, stored, and processed in the United States and in other countries where we or our service providers operate. These countries may have data protection laws that differ from the laws of your country.

Our service providers, including Shopify, may rely on legally recognized transfer mechanisms, such as the European Commission's Standard Contractual Clauses, when transferring personal information out of Europe. You can contact us using the details in Section 17 for more information about international transfers of your information.

10. Data Retention

We keep personal information for as long as it is needed for the purposes described in this Privacy Policy, including to fulfill your orders, maintain your account, provide customer support, and meet our legal, tax, and accounting obligations, and to resolve disputes and enforce our agreements.

How long we keep specific information depends on the type of information and why we collected it. For example, order records are generally kept for as long as required for tax and accounting purposes, and marketing contact details are kept until you unsubscribe or ask us to delete them. When information is no longer needed, we delete or anonymize it.

11. Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information. These may include the right to:

  • know what personal information we hold about you and request a copy of it;
  • ask us to correct inaccurate information;
  • ask us to delete your information;
  • receive your information in a portable format; and
  • opt out of marketing communications at any time.

To make a request, contact us using the details in Section 17. We may need to verify your identity before acting on your request, for example by asking you to confirm details of a recent order or to reply from the email address associated with your account. We will respond within the time period required by applicable law. In some cases we may be unable to fulfill a request in full, for example where we are legally required to keep certain records; if so, we will explain why.

You can stop receiving marketing emails at any time by clicking the "unsubscribe" link in any marketing email. We may still send you non-promotional messages about your orders or account.

12. GDPR Rights for Customers in the European Economic Area and UK

If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, this section applies to you. NOVARIX FASHION LLC is the controller of the personal information described in this Privacy Policy.

Legal bases for processing

We process your personal information on the following legal bases:

  • Performance of a contract: to process and deliver your orders, manage returns and exchanges, and provide customer support.
  • Legitimate interests: to operate, secure, and improve the Site, prevent fraud, and understand how our store is used, where these interests are not overridden by your rights.
  • Consent: to send marketing emails and, where required, to use non-essential cookies. You may withdraw your consent at any time; this does not affect processing carried out before withdrawal.
  • Legal obligation: to comply with tax, accounting, and other legal requirements.

Your rights

Subject to the conditions and exceptions in applicable law, you have the right to:

  • access the personal information we hold about you;
  • have inaccurate or incomplete information corrected;
  • have your information erased;
  • restrict our processing of your information;
  • object to processing based on our legitimate interests, and to processing for direct marketing;
  • receive your information in a structured, commonly used, machine-readable format (data portability); and
  • withdraw consent where processing is based on consent.

To exercise these rights, contact us using the details in Section 17. You also have the right to lodge a complaint with the data protection authority in your country of residence. In the United Kingdom, this is the Information Commissioner's Office (ICO).

13. California Privacy Rights

This section applies to California residents to the extent the California Consumer Privacy Act, as amended (CCPA), applies to NOVARIX.

The categories of personal information we collect, the sources of that information, the purposes for which we use it, and the categories of recipients are described in Sections 2, 3, and 7 of this Privacy Policy. In CCPA terms, these categories include identifiers (such as name, email address, shipping address, and IP address), commercial information (such as order history), and internet or network activity information (such as browsing activity on the Site).

Where the CCPA applies, California residents may have the right to:

  • know what personal information we have collected, used, and disclosed about them;
  • request deletion of their personal information;
  • request correction of inaccurate personal information;
  • opt out of the "sale" or "sharing" of personal information, as those terms are defined under California law; and
  • not be discriminated against for exercising these rights.

We do not sell personal information in exchange for money. You may submit a request yourself or through an authorized agent by contacting us using the details in Section 17. We will take reasonable steps to verify your identity, and an authorized agent's authority, before responding.

Residents of other U.S. states may have similar rights under the laws of their state. You can contact us in the same way to make a request.

14. Children's Privacy

The Site is intended for a general adult audience and is not directed to children. We do not knowingly collect personal information from children under the age of 16. If you are a parent or guardian and believe your child has provided personal information to us, please contact us using the details in Section 17 so that we can delete it.

15. Data Security

We take reasonable steps to protect personal information against loss, misuse, and unauthorized access. Our store runs on Shopify's platform, data sent between your browser and the Site is encrypted in transit using HTTPS, and access to customer information in our store administration is limited to those who need it to operate the business.

However, no method of transmission over the internet or of electronic storage is completely secure, and we cannot guarantee absolute security. Please use a strong, unique password for your account and contact us promptly if you suspect unauthorized use of your account.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time, for example to reflect changes in our practices, the services we use, or legal requirements. When we do, we will post the revised version on this page and update the "Last updated" date at the top. We encourage you to review this page periodically.
